CT, 19 other states win injunction against ICE’s use of Medicaid data

HARTFORD, CT — A multistate coalition appears likely to succeed in its claim that the U.S. Department of Health and Human Services’ decision to allow free access to personal health data to the Department of Homeland Security and its subsidiary, Immigrations and Customs Enforcement violated a prohibition on arbitrary rulemaking, according to a statement from Attorney General William Tong.

Tong, announced on Wednesday that the U.S. District Court for Northern California had granted a preliminary injunction blocking DHS from using Medicaid data from plaintiff states for immigration enforcement purposes. The injunction also blocks HHS from sharing Medicaid data from coalition states with DHS for immigration enforcement purposes. The injunction will remain in place until 14 days after the departments comply with the Administrative Procedure Act or until the legal actions end.
