The Connecticut Hospital Association (CHA) appreciates this opportunity to submit testimony concerning SB 293, An Act Concerning The Statute Of Limitation For Injury Caused By Fraud In The Provision Of Fertility Care And Treatment. CHA seeks modification for clarity.
Connecticut hospitals make our state stronger by delivering nationally recognized, world-class care, supporting jobs and economic growth, and serving communities across Connecticut. Every day, hospitals improve access, affordability, and health equity — providing care to all patients regardless of ability to pay. At the same time, hospitals invest in their workforce and local communities, even as they navigate significant financial and federal challenges.
SB 293 seeks to extend the statute of limitations “for personal injury caused by fraud in the provision of fertility care and treatment.” It is important to recognize that the type of claim involved is not based in negligence — but instead on something much more intentional: fraud.
It would be a significant mistake for the legislature to extend the statutes of limitations for negligence matters because of the sound and long-standing policy reasons that make statutes of limitations necessary. We appreciate that this legislation is limited to acts or omissions of a more culpable nature (fraud).
It is also our understanding that the bill is intended to apply only to fraud causing injuries, that occur after the effective date of this bill and would not be applied retroactively to events that have already occurred. While the clarification about non-retroactivity is included in a parenthetical notation at lines 1-2 of the bill, to avoid confusion, we would suggest including the clarifying language in the bill itself.
